STUDIO POLICIES & TERMS OF SERVICE
Effective Date: September 25, 2026By booking a session and submitting your deposit, you ("Client") explicitly acknowledge, understand, and agree to the following legally binding terms set by ThirdONine Entertainment LLC ("Studio"):1. PAYMENT, BOOKING, & RATES
• Hourly & Project Rates: Client agrees to pay the rate of $20 per hour. The session duration includes all setup, teardown, and file export time.
• Non-Refundable Deposits: A $20 deposit is required to secure your booking date. Your slot is not reserved until this payment clears.
• The "No-Release" Rule: Absolutely no media, rough mixes, master files, stems, or session data will be delivered or transferred to the Client until the outstanding balance for the session is paid in full.2. CANCELLATIONS & LATENESS
• Cancellation Window: You must provide at least 48 hours' notice to reschedule. Cancellations made inside this window forfeit the deposit entirely, but will count towards your next bill. The following deposit will still need to be paid to book.
• The Billing Clock: The session clock begins exactly at your scheduled start time. If you arrive late, the missed time will not be extended, refunded, or credited, and billing will still reflect the original scheduled slot.3. INTELLECTUAL PROPERTY & SAMPLE CLEARANCE
• Ownership of Masters: Subject to payment in full of all outstanding balances, Studio assigns all rights, title, and interest in the master recordings to the Client.
• Producer Contributions: If the Studio engineer/producer provides creative composition, beat production, or songwriting contributions, a separate Producer Agreement must be executed to outline publishing splits and royalties.
• Sample Clearance Indemnity: Client is solely responsible for legally clearing any third-party samples, beats, or copyrighted material they bring into the studio. Client agrees to indemnify and hold Studio harmless against any copyright lawsuits or liabilities.4. DATA STORAGE & FILE MANAGEMENT
• Backup Responsibility: Client is strictly responsible for bringing an external hard drive or SSD to back up their data at the conclusion of the session.
• File Deletion Policy: Studio will store session files for a maximum of 30 days post-session. After this period, Studio assumes no liability for lost, corrupted, or deleted files.5. LIABILITY & EQUIPMENT DAMAGE
• "You Break It, You Buy It": Client assumes full financial liability for the cost of repairing or replacing any Studio gear, microphones, instruments, or property damaged due to negligence or misuse by the Client or their guests.
• Technical Failure: In the event of unforeseen equipment breakdown, software failure, or power outage, Studio’s liability is limited strictly to crediting back the unbillable, lost studio time. Studio is not liable for consequential damages or missed deadlines.6. STUDIO FACILITY RULES & CONDUCT
• Guest & Entourage Limits: Client is limited to a maximum of 2 non-essential guests or entourage members in the control room or live room during the session to maintain a productive environment.
• Substance & Smoking Policy: Smoking and vaping are strictly prohibited inside the facility, especially near sensitive microphone diaphragms. Alcohol and substances are strictly prohibited.
• Food and Drink: All food and liquids are strictly restricted to designated studio lounges. No food or drinks are allowed near the mixing consoles, gear racks, or instruments at any time.
• Right to Terminate: The Studio engineer reserves the right to terminate any session immediately without a refund if the Client or their guests engage in unsafe, abusive, or highly disruptive behavior.Modifications to Terms & Conditions
ThirdONine Entertainment reserves the right to modify, update, or revise these Studio Policies & Terms of Service, membership tier benefits, pricing, and operational policies at any time at its sole discretion. Any modifications will become effective immediately upon being posted on the ThirdONine website or delivered via email notification to the email address associated with your active account. A member's continued use of the membership benefits, studio facilities, or booking services following the effective date of any changes constitutes full acceptance of the revised terms.

This Privacy Policy explains how we collect, use, store, and protect your information when you book sessions, interact with us, or use our studio services.1. Information We Collect
We collect limited personal information necessary to manage bookings, confirm agreement to studio terms, and communicate with you regarding your sessions:• Contact Information: Full name, phone number, and email address.
• Session Details: Booking dates, times, project notes, and scheduling preferences.
• Communications: Messages sent via SMS/iMessage, email, or direct correspondence.2. Bookings & Scheduling
• Third-Party Scheduling Service: Studio bookings, calendar availability, and session reservations are managed through Cal.com.
• When you schedule a session, any information provided during the booking process is subject to both this Privacy Policy and Cal.com’s Privacy Policy.3. Payment Information
• Third-Party Payment Processors: All payment transactions are processed securely through Stripe and/or Cash App Business.
• We do not collect, store, or process credit card numbers, bank account details, or full payment credentials directly on our servers.

• Storage Duration: We store client audio files, stems, multitrack sessions, and completed mixes for a minimum of 30 days following the completion of your session. Files may be retained longer at our discretion or upon request.
• File Delivery: Audio files and mix exports are delivered to clients primarily via Gmail and/or Apple iMessage.
• File Loss Liability Disclaimer: While we take reasonable measures to store and safeguard your project files during the retention period, ThirdONine Entertainment LLC is not liable for file loss, corruption, missing data, or hardware failures. Clients are solely responsible for downloading, verifying, and backing up all final files immediately upon delivery.5. Promotional Media, Portfolio & Social Media (Opt-In Consent)
• Usage Rights: We love showcasing the talent recorded in our studio. However, we will only use your audio tracks, photos, or video recordings taken inside the studio for our portfolio, website, or social media channels with your explicit consent.
• Opt-In / Opt-Out: You will be given the option to grant or decline promotional media consent when agreeing to studio terms prior to your session. You may revoke this consent at any time by contacting us in writing.6. Services Provided to Minors
• Minors (individuals under 18 years of age) may book and record in our studio as paying clients, provided that a parent or legal guardian agrees to our studio terms and conditions and consents to the booking on their behalf.7. Email Marketing & Newsletters
• Marketing Communications: If you opt in to receive studio updates, special offers, or news, we collect your name and email address to send you marketing communications.
• Email Service Provider: We use MailerLite to manage our email marketing list and deliver newsletters and promotional updates.
• Opt-Out / Unsubscribe: You may opt out of receiving promotional emails at any time by clicking the "Unsubscribe" link at the bottom of any marketing email we send, or by contacting us directly.
• Data Handling: Your information is processed in accordance with MailerLite’s Privacy Policy. We do not sell or rent your email address to third parties.8. Third-Party Services
We do not sell, rent, or trade your personal information. We share data only with trusted third-party service providers necessary to operate our business and deliver our services:
• Cal.com (for session booking and calendar scheduling)
• Stripe & Cash App Business (for payment processing)
• Google (Gmail) & Apple (iMessage) (for client communication and file delivery)
• MailerLite (for email marketing, newsletters, and promotional updates)9. Data Security & Client Rights
• We implement standard administrative and technical safeguards to protect your personal details and media files from unauthorized access.
• Your Rights: You may request access to, correction of, or deletion of your contact details or retained audio files at any time by contacting the studio.10. Changes to This Privacy Policy
• We reserve the right to modify or update this Privacy Policy at any time to reflect changes in our studio practices, technology, or legal obligations.
• Any updates will be posted with a revised Effective Date at the top of this page. Continued use of our studio services following any changes constitutes acceptance of the updated policy.11. Governing Law

ThirdONine Studio Memberships: Master Terms & Conditions
Effective Date: September 25, 20261. General Agreement & Applicability
By subscribing to a monthly studio membership (The Independent, The Artist, or The Inner-Circle) via ThirdONine Bookings, the member ("Artist/Client") agrees to abide by these Master Terms & Conditions. These terms apply to all creative partnership tiers unless specifically stated otherwise in the tier-specific breakdown.2. Billing, Automatic Renewal, and Payments
• Billing Cycle: All memberships are billed on a recurring monthly schedule, starting on the initial date of activation.• Automatic Renewal: Memberships automatically renew each month unless canceled at least 24 hours prior to the next billing date.• Failed Payments: If a payment method fails, the membership will be suspended immediately, and all access to tier benefits (including booking studio hours and using rollover balances) will be paused until the account balance is settled.3. Upgrades, Downgrades, and Cancellations
• Upgrades: Members may upgrade their tier at any time. The upgrade will take effect at the start of the next billing cycle. No prorated differences or refunds will be issued for upgrading mid-cycle.• Downgrades: Members may downgrade their tier at any time. The downgrade will take effect at the start of the next billing cycle. No prorated differences or refunds will be issued for the remaining time or unused benefits on the higher tier. Any existing rollover hours/credits exceeding the cap of the new lower tier will be forfeited upon downgrade activation.• Cancellations: Memberships can be canceled at any time. Access to benefits remains active until the end of the current paid billing cycle. Upon termination of the subscription, all accumulated rollover hours and credits are forfeited immediately and are non-refundable.4. Studio Hours, Partial Rollover Policy, and Add-on Services
• Partial Rollover Limits: Unused studio hours and credits do not accumulate indefinitely. Unused benefits may roll over to the immediately following billing cycle up to the maximum cap specified by the member's active tier:• The Independent: Maximum of 2 unused studio hours roll over per month.• The Artist: Maximum of 4 unused studio hours roll over per month.• The Inner-Circle: Maximum of 6 unused studio hours and up to 2 unused Mix & Master credits roll over per month.• Rollover Expiration: Rolled-over hours/credits must be utilized within the subsequent billing cycle. If unused by the end of that second month, they expire and are forfeited.• Excess Forfeiture: Any unused hours or credits exceeding the tier's maximum allowable rollover cap at the end of a billing cycle are permanently forfeited.• Scheduling Restrictions: Sessions booked using membership or rollover hours must occur within an active billing cycle.• Exceeding Allotments: If a member exceeds their monthly allocated hours (including any active rollover balance) or revision limits, standard studio hourly rates and revision fees ($10/revision after the 3-day window) will apply.

Tier-Specific TermsThe Independent
• Scope of Use: For artists building consistency and laying down new tracks month after month.• Benefits: Provides 8 hours of studio time per monthly cycle. Mixing and mastering services are not included and must be purchased separately at standard studio rates.• Rollover Cap: Up to 2 unused studio hours can roll over into the next billing cycle. Any unused time beyond 2 hours is forfeited at month-end.The Artist
• Scope of Use: For dedicated musicians locking in on an EP, mixtape, or consistent single release rollout.• Benefits: Provides 10 hours of studio time per monthly cycle.• Mix & Master Credits: Includes one (1) full mix and master credit per billing cycle (does not roll over).• Revision Credits: Includes 5 free revision credits per billing cycle, waiving standard post-3-day revision fees for those specific adjustments.• Rollover Cap: Up to 4 unused studio hours can roll over into the next billing cycle. Unused Mix & Master credits do not roll over.The Inner-Circle
• Scope of Use: Full studio backing for serious artists creating major projects and running a full-time music release cycle.• Benefits: Provides 16 hours of studio time per monthly cycle.• Mix & Master Credits: Includes five (5) full mix and master credits per billing cycle.• Revision Credits: Includes 20 free revision credits per billing cycle.• Rollover Cap: Up to 6 unused studio hours AND up to 2 unused Mix & Master credits can roll over into the next billing cycle. Unused revision credits do not roll over.• Merchandise Allocation: Includes one (1) exclusive piece of official ThirdONine merchandise upon initial enrollment.Modifications to Terms & Conditions
